Can Independent Contractors Exist After Dynamex?

  • June 28 @ 9:00 am - 10:30 am

Legal Beagle Bagel Breakfast

On April 30, 2018, claiming that the concept of independent contractors was harmful and unfair to workers, competitors and the public, the California Supreme Court severely restricted independent contractor relationships.  Since 1989, California had used the Borello test and the totality of the circumstances to determine the existence of an independent contractor relationship.  However, in the Dynamex case, the Supreme Court criticized Borello and created a new standard affecting independent contractor relationships.  The Dynamex case announced the “ABC test” for determining independent contractor relationships.  However, the court also suggested that its ruling was applicable only to claims that apply to a wage order. Join us at our next Legal Beagle Bagel Breakfast at 9 am on Thursday, June 28th to learn what the ABC test is when it applies, and what consequences this has for your business.
Can Independent Contractors Exist After Dynamex?

  • What is the ABC test?
  • Is it sufficient to meet one of the tests, or must the worker meet all three requirements?
  • When do I use the ABC test as opposed to the Borello test?
  • What changes should I make with my current independent contractors?
  • Has the company incurred liability for using independent contractors in the past who did not meet the ABC test?
