Can Independent Contractors Exist After Dynamex?

On April 30, 2018, claiming that the concept of independent contractors was harmful and unfair to workers, competitors and the public, the California Supreme Court severely restricted independent contractor relationships.  Since 1989, California had used the Borello test and the totality of the circumstances to determine the existence of an independent contractor relationship.  However, in the Dynamex case, the Supreme Court criticized Borello and created a new standard affecting independent contractor relationships.  The Dynamex case announced the “ABC test” for determining independent contractor relationships.  However, the court also suggested that its ruling was applicable only to claims that apply to a wage order.
