Wage & hour litigation has exploded! Lawsuits under the Fair Labor Standards Act have increased 456 percent since 1995. Settlements on wage and hour class action lawsuits reached $595.5 million in 2017. California has created a system – PAGA – for an employee to sue for wage violations on behalf of all employees and recover part of the state’s penalties. State courts have made the prosecution of these cases easier. Plaintiffs’ lawyers have created successful social marketing campaigns attracting employees who otherwise might not sue. The law provides for attorneys’ fees to those lawyers who successfully pursue a wage claim.
