Increased attention has been focused on the pay gap between men and women and also among different ethnic or racial groups. As a result, California’s Equal Pay Act (“EPA”), in effect since 1949, has been amended twice in recent years. The EPA previously prohibited an employer from paying different wage rates between men and women doing the same work in the same establishment. Amendments have significantly expanded the scope and complexity of the EPA. The law will compel employers to take proactive steps to minimize the pay gap. Moreover, employers will want to take certain action to avoid a possible EPA lawsuit.
