The Labor Commissioner, sometimes referred to as the DLSE has become more active and aggressive in investigating and prosecuting claims for alleged wage and hour violations. Just recently, the Labor Commissioner filed three lawsuits in one day. Within the past few weeks we have seen the Labor Commissioner seek allegedly unpaid wages and penalties from employers in amounts exceeding $100,000.
Handling wages in California, including calculating the regular rate of pay, knowing when a meal or rest period premium must be paid, and many other tasks is complex. It is easy to make a good-faith error that can result in substantial liability.
What does an employer do when the Labor Commissioner comes calling? What should an employer expect in the Berman hearing process? And how should an employer respond to a DLSE investigation?
