The Nuts and Bolts of a Wage and Hour Lawsuit

Lawyers are filing thousands of wage and hour lawsuits in California based on alleged violations of the Labor Code. Employees can sue for incomplete paycheck stub information, whether or not wages were fully paid. Missed meal and rest periods now result in an hour of additional pay and can result in an additional 30 days of pay. California now permits for liquidated, or double, damages. The Private Attorney General Act (PAGA) allows an employee to sue on behalf of the state on behalf of all employees and collect a part of the state’s fines and attorneys’ fees. Even the most limited restriction on an employee during the rest period results in a penalty. And any person who violates any provision related to minimum wages or hours can be held personally liable.
