California’s Fair Employment and Housing Act (“FEHA”) protects individuals in the workplace based on sex, gender, gender identity, and gender expression. Over the past year, the Fair Employment and Housing Council has gone through the process of enacting regulations regarding transgender identity and expression. The proposed regulations will result in significant changes in the workplace, including rules regarding access to restrooms, lockers and showers; enforceability of grooming standards based on gender; and using particular language in communicating with employees
