How Can Employers Avoid Liability for the Acts of Employees?
We announced that during 2021 we will focus on the foundations of maintaining quality HR practices and policies.
This month is our last workshop in the series. We will focus on the employer’s liability for the acts of its employees. An employer can be held vicariously liable for the negligent acts of employees when a wrongful act occurs within the scope of employment. An employer can also be liable for the acts of its employees when the employer’s acts contributed to the incident. Under discrimination laws, an employer may be strictly liable for the acts of its managerial employees. Finally, workers’ compensation laws, particularly the going and coming rule, can affect an employer’s liability.
